UP-FRONT GUARANTEE
In this agreement, we are trusted partners, communicating all the
details of a proposed solution and giving you the opportunity to agree
up-front. The up-front guarantee is intended to promote excellent
customer service. We will do our very best but should something go
wrong, there are no written or implied penalties in the up-front
communication guarantee. There are no surprises when people communicate
up-front.
RESPONSIBILITIES OF COMPANY
Rainforest Plumbing & Air shall do all work in a competent,
workman-like manner and in accordance with recognized practices,
standards, laws and regulations.
LIMITED WARRANTY
Rainforest Plumbing & Air warrants plumbing repairs to be free
from defects in material and workmanship for a period of thirty (30)
days from completion unless otherwise stated in writing below or on the
face hereof. Drain stoppages cleared with a blow-bag are not warranted.
Toilet stoppages cleared with a closet auger are not warranted. Drain
stoppages cleared with a snake machine are warranted for a period of 15
days from the completion unless otherwise stated in writing on the face
hereof. Drain stoppages cleared with a jetter machine are warranted for a
period of 30 days from the completion unless otherwise stated in
writing on the face hereof. There is no warranty on drain lines stopped
by roots or collapsed pipe. Price negotiations or price complaints must
be resolved at the time the terms are agreed to on the face of this
contract. All warranties are void if payment is not made when due. All
invoices are due upon receipt unless otherwise stated. Credit is never
extended beyond 10 days. Warranties extend only to the property serviced
and the property owner at the time of service and are not transferable.
If a defect in materials or workmanship covered by this warranty
occurs, RainForest Works, Inc. will, with reasonable promptness, during
normal hours, remedy the defect. In no event shall Rainforest Plumbing
& Air be held liable for water or other damage caused by any delay
in remedying a defect. To obtain warranty performance, notify RainForest
Works, Inc. of any defect or claims for breach at the address and
telephone number on the face hereof. No warranty exists for work done
with customer-supplied materials or where the customer assists or
somehow contributes to or hires others to contribute to the workmanship.
Refunds for pricing disagreements will void all warranties with or
without a customer’s written release of warranty. Technicians are not
permitted by policy to perform side work. If such side work is
performed, the company does not warranty or take any responsibility for
it. This limited warranty is the only express warranty Rainforest
Plumbing & Air gives. IMPLIED WARRANTIES, including, but not limited
to, warranties of merchantability and fitness for a particular purpose,
are limited to the duration stated above from the date of completion.
EXCLUSIONS AND LIMITATIONS:
The customer's right to repair and replacement are our exclusive
remedies. Rainforest Plumbing & Air shall not be liable for
incidental or consequential damages resulting from the material provided
in this contract. Rainforest Plumbing & Air is not responsible for
the following, which are excluded from the coverage of this limited
warranty: 1. Defective conditions listed under the above
“Responsibilities of Customer”. 2. Work performed by or materials
installed or supplied by others. 3. Defects and failures from
mistreatment or neglect. 4. Damages due to neglect of remedy. 5. Cable
entanglement in sewer or drain due to offset, broken, or damaged line.
6. There is no mold coverage.
PROTECTION OF CUSTOMER’S PROPERTY
The customer agrees to remove or protect personal property, inside
and out, and Rainforest Plumbing & Air shall not be responsible for
damage to said items. Nor shall Rainforest Plumbing & Air be held
responsible for the natural consequences of work done which may cause
damage to improvements to real property including, but not limited to,
curbs, bricks, borders, sidewalks, walks, driveways, garages, patios,
lawns, shrubs, sprinkler systems, wallpaper, drywall, stucco, tile,
carpet, rugs, cabinets, appliances, electronics, furniture and other
appurtenances to the residence or other real property. Tire marks on and
damage to sidewalks and driveways are an unfortunate consequence of
certain equipment use and cleanup of such marks is not provided under
this warranty. Rainforest Plumbing & Air shall not be held
responsible for damage to personal property, real property, or any
improvements to real property caused by persons delivering materials or
equipment or keeping gates and doors closed for children and animals.
The customer agrees to allow the technician to make access to the repair
area as necessary including but not limited to cuts to drywall, block
walls, concrete, cultured marble, tub or shower enclosure, etc. Breakage
of materials, such as what can occur when accessing cultured marble
enclosures, are the responsibility of the customer since attempts to
such access are authorized by the customer.
